Through this website we at Zimbali Bookings provide an online platform through which hotels and all types of temporary accommodation including short term bookings, can advertise their rooms establishments for reservation, and through which visitors to the website can make such enquiries for reservations. By making an enquiry for a reservation through zimbalibookings.co.za or any of our sister websites the individual browser is aware that you are not dealing with the establishment Itself. From the point at which you make your enquiry for a reservation, we act solely as an intermediary between you and the hotel/establishment owner by transmitting the details of your reservation to the relevant hotel/establishment owner and sending you a confirmation email for and on behalf of the hotel or establishment owner.

When making a booking through the Zimbali Bookings website our extenuating circumstances policy and terms and conditions apply to your booking upon part or full payment for accommodation at one of our establishments.

When rendering our services, the information that we disclose is based on the information provided to us by the establishments/hotels. Although we will use reasonable skill and care in performing our services we will not verify if, and cannot guarantee that, all information is accurate, complete or correct, nor can we be held responsible for any errors (including manifest and typographical errors), any interruptions (whether due to any (temporary and/or partial) breakdown, repair, upgrade or maintenance of our website or otherwise), inaccurate, misleading or untrue information or non-delivery of information. Each establishment remains responsible at all times for the accuracy, completeness and correctness of the (descriptive) information (including the rates and availability) displayed on our website. Our website does not constitute and should not be regarded as a recommendation or endorsement of (the quality, service level or rating of) any hotel/establishment made available.

Our services are made available for personal and non-commercial use only. Therefore, you are not allowed to re-sell, deep-link, use, copy, monitor (e.g. spider, scrape), display, download or reproduce any content or information, software, products or services available on our website for any commercial or competitive activity or purpose.

2) Delivery policy

Subject to availability and receipt of payment, requests will be processed within 3 days and booking confirmed by way of email.

3) Return and Refunds policy

The provision of services by Zimbali Bookings is subject to availability. In cases of unavailability, Zimbali Bookings will refund the client in full within 30 days should we not be able to place the client in alternative accommodation of equal or higher amenities and standard. Reservations cancelled 21 days or more prior to arrival – 50% of the booking value will be forfeited. Reservations cancelled 14 – 21 days prior to arrival – 75% of the booking value will be forfeited. Reservations cancelled less than 14 days prior to arrival – full booking value will be forfeited. Should the booking not fall within the above mentioned cancellation period due to a short lead, please note that the full booking value will be forfeited.

4) Customer Privacy policy

Zimbali Bookings shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal
information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/attachment.php?aa_id=3569.

5) Payment options accepted

Payment may be made via Visa, MasterCard, Cards or by bank transfer (EFT) into the Zimbali Bookings bank account, the
details of which will be provided on request.

We do not accept a Bank payment notifications via Fax, Email, SMS or any other format as proof of deposit; a proof of payment from your bank is required. Payments need to clear in our Bank account 24 hours prior to the date of your booking.

6) Card acquiring and security

Card transactions will be acquired for Zimbali Bookings via PayGate (Pty) Ltd who are the approved payment gateway for all South African
Acquiring Banks. DPO PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

7) Customer details separate from card details

Customer details will be stored by Zimbali Bookings separately from card details which are entered by the client on DPO PayGate’s secure site. For more detail on DPO PayGate refer to www.paygate.co.za.

8) Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is South African Rand (ZAR).

9) Responsibility

Zimbali Bookings takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website,
customer service and support, dispute resolution and delivery of goods.

10) Country of domicile

This website is governed by the laws of South Africa and Zimbali Bookings chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

11) Variation

Zimbali Bookings may, in its sole discretion, change this agreement or any part thereof at any time without notice.
